(CNN) – Donald Trump’s campaign lawyers withdrew the lawsuit calling for a review of all ballots cast on election day. The move came after discovering that the margin of victory for the presidential race in Arizona could not be exceeded.
“Since the hearing closed yesterday, the tabulation of votes across the state has made a court ruling on presidential voters superfluous,” Trump’s campaign wrote in a dossier. The campaign said it wanted the judge to rule on his requests to review the votes for two opposing elections.
Trump’s campaign filed the lawsuit on Saturday arguing that some voters were confused on election day and feared their votes would not be counted if the vote-tabling machines classified their votes as overvote. They were looking for a manual review of ballots marked by the machine as “overvote” on the grounds that they could lead to thousands of votes for President Donald Trump.
During a six-hour hearing yesterday, a Trump campaign attorney withdrew his request and told the judge he would only ask for a review of the vote counts if the number of so-called overvotes exceeded the margin of victory.
The judge reserved the decision. Maricopa County lawyers and the Secretary of State said the machines marked 191 ballots as possible overvotes for the presidential run.
CNN predicted on Thursday that Joe Biden would win Arizona. He has a vote margin of over 11,000 votes on Trump.
Maricopa County lawyers and the secretary of state released documents on Friday noting that the latest vote is “irrelevant” to Trump’s campaign claims. They reported that the vote difference between Biden and Trump is 11,414 votes with 10,315 votes remaining. The total number of votes marked as possible overvotes was 191.
