Swedish prosecutors filed a lawsuit against the woman accused of keeping her son locked up at home for 28 years, saying there is no evidence the man was arrested against his will, the BBC reports.
The 70-year-old woman from Stockholm was arrested after her daughter filed a police complaint, but was released following the decision of prosecutors.
He denied holding his son captive and hitting him after his son, now in his 40s, was found injured, malnourished and in dire misery.
“I found no evidence that he was locked up, bound or physically prevented from leaving the house. There is no indication that there were spaces in which he was imprisoned,” said attorney Emma Olsson for the AFP news agency.
“The man also said he could leave the apartment if he wanted to. He is an adult and he could leave if he wanted to,” he added, recalling that neighbors saw him outside the apartment several times.
Olsson also told reporters that the man’s injuries cannot be attributed to violence.
According to Swedish media, the man’s sister went to the apartment on Sunday after learning that her mother was in the hospital. She said she moved out of the apartment when she was a teenager and hasn’t seen her brother since.
The woman also says that, as a child, she tried in vain to raise the alarm about the well-being of her brother, who had been removed from school when he was 11 or 12 years old.
When he reached the apartment, the door was open, the apartment was dark and smelled of urine. His brother was in the kitchen with leg injuries.
When the man was taken to the hospital, doctors alerted the police and his mother was arrested.
Prosecutor Olsson said social services are now investigating the case, including being taken out of school and being isolated at home.
“Her ability as a mother may be questioned, but now it’s social services,” she said.
