Pennsylvania Democrats urge the state Supreme Court to allow post-election ballot counting

Pennsylvania Democratic Party attorneys told the Supreme Court on Friday that they oppose any order blocking any recount of ballot papers received after the election.

The legal filing came in response to Republicans in the state, who are asking the court to order counties to “not act” on the ballots in question while a legal dispute develops.

Early Friday, Judge Alito, acting alone, preserved the status quo by ordering counties to follow current guidelines directing counties to separate voting; if they are counted, they should not be added to the current counts. He referred the matter to the plenary session for consideration.

Attorneys for Secretary of State Kathy Boockvar are expected to answer today at 2pm.

These legal documents occur when the court is considering whether to accept an appeal against a Pennsylvania Supreme Court decision prior to the election. This decision made it possible to count the ballots received 3 days after the election, even without a valid postmark. The magistrates have not yet decided whether to resume the dispute.

Critics of the president and other Republicans say it continues with legal challenges to suggest that courts could influence election results, although the numbers, so far, suggest otherwise.
