There are 17 charges against Avianca for violating passenger rights

According to a press release, the Supertransporte received a series of complaints, between March 24 and September 29, 2020, for alleged irregularities that Avianca committed “relating to the alleged violation and non-compliance with the obligations that legally correspond to its users“.

Among the 17 charges that the body has made to the airline there are alleged violations during the transport of passengers from one destination to another; violation of the right to information by do not provide flight data in Spanish and do not announce changes to passengers o delays occurred; violation of users’ right to request refunds for flights not taken and “impose unfair terms in the terms and conditions for redeeming vouchers or vouchers delivered“.

Camilo Pabón Almanza, superintendent of transportation, added in a video (posted below) that some airline users reported that their flights were canceled, even when passengers were already on the plane, and that complaints are also were taken into account that users have done through social networks, in October.

The Superintendency of Transportation reported that if Avianca is responsible for what it is accused of, it could be fined more than 19,000 million pesos, which represents 21,950 Current Monthly Legal Minimum Wage (SMLMV).

The airline, which recently announced that it would lay off some 6,000 workers, had already had problems with that control body for airline ticket advertising, without having permission to reactivate flights.
