Netflix has settled a lawsuit for its interactive special Bandersnatch. Second The Hollywood Reporter, Netflix announced on Monday the agreement with the book publisher Choose Your Own Adventure Chooseco. The deal ends a bitter legal fight between Netflix and Chooseco, which claimed the streaming video platform had infringed on its brand.
Chooseco sued Netflix in early 2019 after the release of Bandersnatch, a movie about a branching path about a game developer obsessed with a “choose your adventure” book (but not necessarily Choose your adventure). Chooseco is known for aggressively defending its brand against other companies and even small game developers, and claimed Netflix was using the name illegally. Netflix responded with a counterattack, asking a court to invalidate the Choose Your Own Adventure brand as a generic term.
The terms of the transaction are not public. But it appears that in addition to ending a legal headache for Netflix, it retains Chooseco control over the Choose Your Own Adventure brand. This is a disappointment for anyone who wanted an effective decision on the legal status of the term.
