The elections are definitively closed. Not those of the United States, but those of our towns and villages in Limousin. Because if the municipal elections may already seem distant, they are much less so for the magistrates of the administrative court of Limoges and for the municipalities that have used it to cancel the elections, due to one or more alleged irregularities. The magistrates examined these appeals between the beginning of September and the end of October.
Only 41 sessions!
One would have thought that the rate of appeal to the administrative court, given the particular health context we know and the organizational difficulties it has caused, would have exploded. It is not so. In reverse. While the Limoges Administrative Court registered around 140 appeals for the 2014 municipal elections, only 41 were filed this year. 15 in Indre, which reports to the administrative court of Limoges, 7 in Corrèze, 8 in Haute-Vienne and 10 in Creuse, of which three for the municipality of Saint-Dizier-les-Domaines alone
. Amazing. Especially since deadlines have been extended due to the health crisis. The president of the court, Patrick Gensac, is careful not to make a clear analysis of this phenomenon, above all because “we would be an exception. Other jurisdictions can recur at least as much as during the last municipal elections ”, the president specifies. “Perhaps the results were clearer, he says. It is when the scores are very close that most disputes are recorded. “
The most important municipalities affected by a procedure are Brive and Aubusson, but the court rejected the two appeals, not finding any irregularities.
No irregularities observed in Haute-Vienne
Only the municipalities of Confolent-Port-Dieu and Lapleau in Corrèze, Fursac and Saint-Didiez-les-Domaines in Creuse have seen their election results changed. No irregularities were found in Haute-Vienne among the eight appeals filed.
Sometimes, especially in very small countries, it doesn’t matter. Except a ballot… As in Confolent-Port-Dieu, in Corrèze, where the controversy concerned the admissibility or not of a ballot, rejected during the elections because the office believed it carried a sign of recognition. But the court ruled that the vote was valid and returned it to the votes cast. Consequence: one candidate found himself tied up with another elected candidate and the privilege of the right age, it was he who was finally elected in the other’s place. For example, every voice counts.
Sincerity of the ballot?
“We had some questions about whether the information provided by the government would not increase the number of abstentions, questioning the sincerity of the ballot, resumed President Gensac. But the Constitutional Council decided on the matter in May saying that it is necessary to prove a very important abstention and very tight results to question the sincerity of the ballot and we did not have this type of case ”.
The disputes were “classically” over the validity or otherwise of the ballot papers, as well as in Fursac where a large number of invalid city council ballots were revalidated by the court, or on campaign problems, such as the distribution of leaflets at the ‘last moment or to the outgoing mayor who would start his campaign out of time, during the New Year for example …
However, in early November in Limousin, all elected officials were effectively elected regularly.

In Corrèze: Beyssac, Brive-la-Gaillarde, Confolent-Port-Dieu, Curementonte, Espartignac, Lapleau and La Chapelle Saint-Géraud.
In Creuse: Ahun, Aubusson, Fursac, La Chapelle Baloue, Montaigut le Blanc, Pontcharraud, Saint-Didiez-les-Domaines and Saint-Moreil.
In Haute-Vienne: Dompierre-les-Eglises, Eyjeaux, Lavignac, Mailhac-sur-Benaize, Rilhac-Rancon, Saint-Genest-sur-Roselle, Saint-Junien-les-Combes and Saint-Pardoux.
