The leaflets accuse the Boulder County commissioners of "treason" in paving decisions

Someone upset by the Boulder County commissioners for the creation of a local improvement district has produced leaflets claiming that each of the three commissioners is "wanted for treason" and for "taxation and crimes against the state".

The leaflets turn to the commissioners for a special assessment district to finance the paving of roads in nearly 120 rural residential subdivisions, with some flyers stating, "How would you like to be taxed $ 7,000 on the street in front of your house?"

But Chuck Wibby, co-president of Boulder County Fairness in Road Maintenance, said the organization has nothing to do with the production or distribution of leaflets. BoCoFIRM opposes the local improvement district of the county subdivision and county assessments on nearly 10,900 properties.

All three groups of leaflets – each with a picture of one of the commissioners – were taken home by Commissioner Cindy Domenico's Lafayette last week. The leaflet with the photo of Commissioner Elise Jones was distributed in the Jones neighborhood in Boulder.

Commissioner Deb Gardner, who lives in Longmont, said on Thursday that he did not see any of the flyers before leaving on vacation last week, but may have been there since then.

"It's hard to say who did it," Domenico said on Thursday. "They were anonymous."

Domenico said that his reaction to the leaflets "was the disappointment, more than anything else". He said his producers seem unable or unwilling to have a "civil speech" with the commissioners on the question of who should pay to rehabilitate subdivision roads.

Dominic said her husband found the three separate flyers, one with his picture, one with Jones & one with Gadner's, outside their home on December 19th.

"I do not know how many of Domenico's neighbors have taken them," he said.

The leaflets delivered to Domenico's home included his home address and telephone number, an incorrect home address for Jones, and neither a home address nor a telephone number for Gardner.

Wibby said he would contact the BoCo FIRM attorney "to see what we can do if we find out who is responsible".

In a separate e-mail to the other members of the FIRM Steering Committee, Wibby asked them if they had any information about who produced or distributed the "treason" leaflet that included the web address of that organization "without our permission or knowledge ".

Wibby said he would forward this information to the FIRM attorney "to determine whether or not we have legal appeal against the person (s) responsible."

Wibby is a plaintiff in a lawsuit filed in November that states that the LID violates the laws of the state and the Constitution of Colorado. The plaintiffs argue that the LID assessments amount to a "new tax", "an increase in the tax rate" or "a change in tax policy", situations in which the State Taxpayer's Rights Card requires prior approval of voters.

Gardner said, "I think it's a shame that this has become so personal … I do not think it's a good way to discuss the problem."

Jones said that anonymous leaflets were "a little frightening, sincerely", even though he added that "I believe he goes with the territory" to be elected in the middle of debates on a controversial topic.

"No one argues with a Democrat give-and-take" during debates on a problem, said Jones, but said the leaflets go "over the top" when people who do not agree with the subdivision of Commissioners who pave the district decisions classify those decisions as "betrayal" ".

He said Jones: "It's really unfortunate, and it's inappropriate".
